Construction of the Industrial Palace: The municipality received a fine from the state due to errors in the contract
According to the ÚOHS, Prague had a tender unreasonable requirements for the qualifications of contractors given the complexity and scope of the work. For example, it required that the lead restorer in the supplier team have experience in a similar position on at least two, each of which included restoration of polychrome and non-polychrome sculptural works of art made of stone and stucco or wood for at least ten crowns.
“At the same time, according to the Office, this amount significantly exceeded the financial volume of restoration work to be published in connection with the reconstruction of the Industrial Palace,” the office said in a press release.
The municipality does not like the decision
Prague filed an appeal against the office’s decision to the chairman Petar Mlsna, but he rejected it. “If the contracting authority requires this person to provide evidence of experience in performing performance worth ten million crowns, his request is not reasonableif this person will cover the supervision of work worth less than the volume of work with which he is supposed to have a lot of experience,” Mlsna said.
He also rejected the objection to the disproportionate amount of the finewhich according to the law could reach up to 264 million crowns, but the imposed amount is at the level of one percent of the maximum possible fine.
