Prague 4 will file a lawsuit against the construction of a high-rise building near the Budějovická subway

Prague 4 City Hall will file an administrative lawsuit against the construction of a nineteen-story building on the corner of Budějovická and Vyskočilova streets. The reason for filing the lawsuit is that the municipality allowed the building to protest the town hall. Prague 4 has no other option but to try to overturn this decision in court, city hall spokesman Jiří Bigas told ČTK today.
In November 2021, the municipal department of building regulations ordered the building authority of Prague 4 to issue a decision. The municipality argued that it was a procedural step to eliminate the inactivity of the building authority and that the municipality did not assess the function itself, such as the legality of the construction. Prague 4 did not agree with this.
According to the fourth city district, the AC Budějovická building planned by developer Opal Real is oversized, deteriorating the quality of life and the traffic situation. A local resident had previously written a petition against the construction of a 72-meter-tall building, and the town hall issued several dissenting opinions.
“We repeatedly point out, above all, the fact that the developer’s plan is in conflict with the regional plan, exceeds the neighboring development and violates the lighting regulations. Other concerns stem from the increase in car traffic in a traffic-congested locality, and in addition, the diversion of traffic to side streets will have a negative impact on the safety of pedestrians in the adjacent neighborhood, where apartment buildings and a kindergarten are located,” said Deputy Mayor Patrik Opa (ODS).
The municipal district council insists that the nineteen-storey AC Budějovická building is not, especially in terms of its height, in accordance with the spatial plan, specifically with the limits of possible development in a stabilized area.
This follows from the expert reports that the town hall had prepared, as well as from the decision of the municipal department of building regulations from February 1, 2016. However, the municipality changed its resolution in November 2021. According to the representative of the town hall, this happened without giving a reason.
The new AC Budějovická house is to have a regular, almost square floor plan with a slightly beveled corner parallel to Vyskočilová Street. It is to be up to 72 meters high with 19 above-ground and five underground floors with 70 garage spaces. The tower is to contain up to 12,000 square meters of offices.
