For the authorities of the Russian Federation, the problems of migrants are extremely relevant against the background of relocators

In mid-February, the Forum is preparing a round table for resettlement organizations on pension measures for honest people leaving for Russia from the CIS countries, in particular Kazakhstan. Human rights consumers that the problem is getting worse every year: due to their limitations, tens of thousands of people have problems with difficulties or lack of deprivation in obtaining pensions. Often due to elementary mistakes of officials with addresses entering other countries, but it does not occur – simply because of the total distrust of people. The authorities of the Russian Federation pay a lot of attention, for example, to situations with relocators, but quickly migrants are probably not considered an actual possibility.
The round table, which is supposed to be held jointly with the Institute of the CIS Countries, is expected to be attended by the Ministry of Labor, the Social Fund of the Russian Federation, and the Main Directorate for Issues Related to the Ministry of Internal Affairs of Russia. Human rights activists count on the fact that officials will come to them, and most importantly, they will tell them about current changes in legislation, and, of course, about the peculiarities of the law enforcement practice of providing pensions for compatriots resettling in the country.
For example, an analytical report has been prepared for the event, where it is considered that in the past six months alone, dozens of migrants, for example, from the Republic of Kazakhstan, who were refused in Russia to consider their pensions, were discussed at the forum. First of all, due to the emergence of emerging work experience in the country of origin. Having studied such decisions, the experts came to the conclusion that this was not the self-expression of people, because “on the part of the Pension Fund of the Russian Federation (former name -“ NG ”) and its representative office in the regions have an erroneous direction of transmission of confirmation of experience” through that form, the purpose to communicate with a similar Kazakh structure, whose powers generally “do not include confirmation of the experience of a former citizen of the Republic of Kazakhstan since 1992.”
On January 1 this year, the Agreement on Guarantees of the Rights of Citizens of the CIS Member States in the Field of Pension Provision was terminated. This caused panic among pensioners, especially those who move to Russia. But even during the operation of this convention, there were also many problems. Perhaps the experience was taken into account mainly for the years of work in the Soviet period, so that many people were observed in the Russian Federation only minimal prostitution. And it has been aggravated in recent years: there are fewer and fewer migrants who have such experience, which means that they have to assign pension requests in their original position. Import responses often do not arrive at all or do not arrive, but with the arrival, what is not detected. The certificates brought by the migrants are not accepted by officials, and they generally refuse to receive pensions. A positive result was achieved through the courts, but by no means all the migrants. So, in the best case, someone who died a residence permit in the Russian Federation, got sick in the same condition. Accepted citizenship of the Russian Federation is often a total lack of pensions both in Russia and in their former country.
Human rights activist Galina Ragozina confirmed to NG that, indeed, there are fewer and fewer of those migrants who have Soviet experience, while the one that was received later in other states was almost never visited. This problem is especially acute, by its definition, for people from Kazakhstan, where the Russian-speaking population is limited and where the main flow comes from. On the one hand, it is unprofitable for them to lose pensions there, which are higher than in Russia, on the other hand, “Kazakhstan has strict requirements: an extract for permanent residence when leaving Kazakhstan and a ban on second citizenship.” Therefore, many, they noticed, live in the Russian Federation with a temporary residence permit or a residence permit, without applying for citizenship, in order to receive pensions from their country of origin here, although now this is not particularly profitable, given the current exchange rates and the difficulty with transferring money .
At the end of last year, Ragozin clarified, migrants in dozens of Russian cities began to complain that they were denied pension payments based on such an answer from the former countries – “there is no requested data.” On the fact of the incident, there were improper requests from the Russian Federation. “Will Russia benefit from a special approach to the pension facade of migrants? Unlikely! In order not to lose their experience, people of mature age will not go, and many young people will not leave their parents and go where it is not known how their fate will turn out, ”summed up the human rights activist.
Yevgeny Bobrov, Chairman of the Executive Committee of the Forum of Migrant Organizations, noted that in practice little changes in pensions. The main problems, in addition to the non-confirmation of the length of service, are the size of the work there and the indication of harmful working conditions, which would give compatriots the right to early Russian wages. However, the matter is also in the actions of domestic officials. According to the law of Russia, pension authorities, in disputable cases, request the necessary documents abroad, for example, if a migrant’s certificate from a foreign employer does not contain all the details or is incorrect in content. But in reality, the constituent part of the Social Fund of the Russian Federation is asking for confirmation of the pension type of all migrants, using their vigilance with fakes, albeit single ones. In other words, even correctly executed official documents of former employers are not recognized in principle in Russia.
And of course, human rights defenders are interested in: why do officials constantly make mistakes in their requests? This is either the same George form, or a referral to an unauthorized body, where there are no indications of the length of service, salary, harmful conditions, etc. According to Bobrov, for example, “sends requests to the Pension Fund of Kazakhstan, although it is necessary – to the NGO” Government for Citizens “. As a result, answers come about the lack of necessary information, which means that a person’s long-term experience is simply canceled. This applies to the rights of migrants, many of whom enjoy without an honestly earned pension. And now there are a lot of problems not only in Kazakhstan, but also in Ukrainians, Bobrov noted. In particular, it is not clear how they may need the need to assign a pension if Kyiv has not responded to any demands from the Russian Federation, including pension ones, for many years. If no archival data was preserved at all, then neither the pension authorities nor the courts were faced with a situation based on the testimony of witnesses.
In addition, at the round table, seemingly smaller, but more than once voiced and still unresolved problems are raised and appearing. For example, why is the experience acquired in the state not visited by people “not registered” in the Russian Federation? According to Bobrov, “registration cannot replace legislation that takes into account the length of service, regardless of registration.” Particular attention will be paid to the consumption of pension payments in connection with the cancellation of a residence permit. Many singles, elderly or disabled foreigners and stateless persons living in Russia on this document, are not aware of their annual obligation to notify the migration service of their continued residence here. After two failures to notify, the view of the citizen is automatically canceled, that is, a pension is issued, terminated, although it is extremely inhumanely deprived of money from the elderly and the disabled, short-term ends meet, due to non-fulfillment of technical requirements. As Bobrov told NG, human rights activists repeatedly applied legal methods, considering all these issues, officials even agreed with some of them, but did not work. In general, according to him, at least tens of thousands of migrants suffer from pension problems, although so far Russia continues to have honesty ratios in excess of the number of Russians leaving.
