Viktor Orbán: it is our duty not to significantly harm our identity
Budapest – The government must protect Hungary’s constitutional identity, even if this is contrary to the ruling of the European Court of Justice.
The Hungarian state has an obligation to complain about a significant violation of its identity, even if it is due to the ruling of the European Court of Justice or its permanent shortcomings, Viktor Orbán wrote in his 15th issue of Samizdat, published on the Prime Minister’s website on Monday.
The Prime Minister reminded that the European Court of Justice had ordered Hungary to admit migrants who had been detained by the Hungarian border guards so far, in accordance with the rules of the Basic Law.
Hungarian border guards did not allow migrants to enter. If they did so illegally, they could not stay in Hungary. They had to process the application for asylum outside Hungary – wrote Viktor Orbán.
Due to the decision of the European Court of Justice, the Hungarian government appealed to the Constitutional Court (Ab)
with the question of what to do. The Ab has made three decisions, the prime minister said.
On the one hand, he confirmed that the government must protect Hungary’s constitutional identity, even if this is contrary to the ruling of the European Court of Justice.
On the other hand, he stated that the institutions of the union do not exercise the shared competences effectively, they can be exercised by the Hungarian authorities.
He also stated that the relationship between migration and human dignity should be examined from the point of view of indigenous peoples, he added.
Viktor Orbán called the decision of the Constitutional Court a decision of historical significance, which is “not an easy read”. The focus is on the human person and human dignity “as it is seldom seen in Europe,” he said.
He wrote: In defending human dignity, the government of international courts has followed the same path as the societies of “progressive Europe” in general. The individual was torn from his natural national, linguistic, cultural family, religious communities. It is denied that belonging to such communities is part of self-identity and thus of human dignity, and that it deserves protection from fundamental rights.
Today, there are only individuals who are “people without qualities,” who can live anywhere, speak any language, and pray to any god, he added.
According to Viktor Orbán, traditional communities have become completely defenseless because not only political progression but also the law is facing them.
Today, Europeans have no right to decide who they want to live in a homeland, even if mass immigration leads to the disintegration of the traditional communities that underpin their individual identities, he stressed. He put it this way: “Ultimately, in the sense of fundamental rights, Europeans today have no right to their homeland, their language, their culture, their family and their God.”
The prime minister has indicated that the decision of the Constitutional Court, on the other hand, takes a stand, “restoring the human rights system from head to toe”. He drew attention to the fact that in this light it is worth reading everything that the board writes about the competences of the European Union and the sovereignty of Hungary.

it cannot happen that the traditional social environment of the people living in Hungary changes without democratic authorization and state control.
“Home is only where there is a right,” Viktor Orbán emphasized at the end of his writing, adding that according to the Constitutional Court, Hungarians have a right to their own country.
