Danish court explained the refusal to arrest the Russian ship “Akademik Ioffe” – RBK
Despite the fact that the claims of the Canadian company against the owner of the Russian research vessel are laws that prevent the arrest he was helped by Danish law
Denmark Western Court of Appeal published the decision to lift the arrest of the Russian research vessel “Akademik Ioffe”. It stresses that, under Danish law, the judicial authorities cannot be seized.
The arrest on “Akademik Ioffe”, as stated in the published message, was imposed in connection with the lawsuit of the Canadian company, which in 2018 rented a Russian research vessel for a cruise. “The High Court ruled that this should be viewed as a public purpose of a non-profit nature. Thus, the third section of the court on the courts of foreign states is an obstacle to the arrest of the vessel, ”the decision reads.
Denmark removed the arrest from the Russian “Academician Ioffe”
The Russian Embassy in Denmark confirmed to RBC that the arrest from the vessel had been lifted and the crew of the Akademik Ioffe had already been notified of this. “During the meeting, it was emphasized that the Russian ship is a state-owned vessel and was on the way to conduct an oceanographic scientific expedition, which is classified as a non-commercial goal,” said Konstantin Akimenko, press secretary of the Russian Embassy in Denmark.
In August 2018, Canada’s One Ocean Expeditions leased three vessels from the Institute of Oceanology, including the Akademik Ioffe. On August 24 of the same year, Akademik Ioffe ran aground off the coast of Canada. Then One Ocean Expeditions had to cancel nine cruises with sold out seats. The company lost $ 6.5 million in ticket refunds.
