Alexander Zhuravlev, Chairman of the Commission on Legal Support of the Digital Economy of the Moscow Branch of the Russian Lawyers’ Association, spoke about the main task of the law “on landing”.
“The main objectives of the Land Law are to make Russian legislation applicable to those companies that have been operating in our market for a long time, but have not been localized, and to Russian companies. Task number two is to build some kind of parity between foreign and Russian companies. As of today, we have tax obligations that Russian companies fulfill in full, while foreign companies can evade obligations. It is also important that all users on the territory of Russia exercise their rights, including litigation, but not spend a lot of money on it. To sue and execute judicial acts on the territory of Russia. Also important is the point about personal data, which today have become the “fuel” for cybercrimes. They need to be especially protected, since the digital economy is a data economy. And fourth: this is an international trend, which is observed in other countries, for example, Australia, Turkey, the countries of the European Union. Everyone dictates the condition of the need to land or the appointment of missions, ”he admits.
The expert also appreciated the need for joint work of the Russian authorities and specialists with foreign colleagues.
“I believe that the work of the Russian authorities and an expert with foreign colleagues is necessary, because foreign companies, when opening their subsidiaries, must understand all the working conditions. For example, about tax preferences. The Ministry of Digital Development maintains special registers for the registration of IT companies, which provide special benefits. Access in public procurement is also available. This must be used for nutritional benefits. Some companies will want to open representative offices or branches, and the law requires a private representative when registering. And in the world now there is a situation related to covid. And this barrier can become the basis for difficulties when opening a branch, it must be removed. Therefore, it is important that the work is carried out in cooperation, dialogue is important. This will help companies “land” without any problems on the territory of the Russian Federation. I think the dialogue is logical and necessary, ”he said.

During the meeting, Roskomnadzor and industry experts explained to representatives of foreign IT companies the procedure for applying new rules that oblige foreign online platforms to open their official offices in Russia from January 1, 2022. As noted, Roskomnadzor will not apply measures to influence companies that do not meet the deadline.
