An environmental association ready to attack the Town Hall of Toulouse against light pollution
The environmental association FNE Midi-Pyrénées says it is ready to take legal action against the Town Hall of Toulouse to force it to act against light pollution.
After several years of raising awareness, it’s time to take action. The environmental association FNE Midi-Pyrénées announced this Wednesday, January 25 that she is ready to sue the Town Hall of Toulouse. She criticizes the municipality for not taking action against light pollution.
The regulations in force provide that the lights illuminating the heritage and the parks and gardens are accessible to the public, but also the lighting of the windows of shops or exhibition must be turned off no later than 1 a.m. or one hour after closing. With regard to commercial premises, the lights can be switched on from seven hours or one hour before the start of the activity.
Noting that this regulation was not respected, the FNE Midi-Pyrénées launched marauding in 2017 in order to challenge local authorities. ” It is up to the mayor to ensure that these rules are applied in view of the impacts of this pollution (economic waste, impacts on health and biodiversity, etc.), point out the association.
Light pollution: 36 businesses in violation in Toulouse
“After six years of observations, raising awareness and exchanging letters with traders and the Toulouse City Hall, our approved association is now forced to take legal action to enforce these regulations,” said the local branch of France Nature Environnement.
The association had it noted by bailiff 36 shops lit after one o’clock in the morning January 6, 2023. It asks the Town Hall of Toulouse “to kindly notify the formal notices to cease illegal night lighting to those expected as soon as possible. »
” In the absence of a positive response, we will seize the administrative court of Toulouse a request for cancellation accompanied by an injunction to put an end to this unacceptable waste at the time”, indicates Hervé Hourcade, lawyer of FNE Midi-Pyrénées.
