Flink dark store in West still not closed (while the municipality and judge have to) | Amsterdam
NewsFlink’s dark store on the Van Limburg Stirumplein in Amsterdam-West should have been a court decision on December 30 last Friday, but is not always open yet. The municipality therefore wants to claim a penalty of 20,000 euros.
There is a lot to do around the darkstore all the time. A year ago, local residents started one petty, with which they collect the flash delivery driver to move to a certain location. If that was not possible, the company would at least have to comply with a number of rules: an impassable sidewalk and no trucks driving all day long. The petition has been signed more than 1300 times.
But the flash delivery person ensures that this is not the case and local residents submit enforcement requests to the municipality, because they believe the dark store would not fit in the district. The municipality passed on October 4, 2022 Close. Flink went to court, but decides the case. The judge has decided that the dark store had to be closed at midnight last Friday, but deliveries are still being made from the location.
‘In constructive consultation’
The flash delivery person says via a statement that the dark shop is indeed still open. “Flink is in constructive consultation with the municipality and expects clarity about the follow-up in the short term.”
A statement from Alderman Reinier van Dantzig (Spatial Planning) says that both parties are in talks, but that these talks are about moving the dark store. The city council recently made it possible for flash delivery drivers to open new branches on business parks. That was not the case before, because there is still one preparatory decision is located, making the opening of new darkstores prohibited. Now that companies’ sites are exempt, there is hope that Flink can find suitable premises there.
However, the fact that both parties are discussing a move is no reason for the municipality not to enforce the penalty on the building in question. And so the municipality now wants to claim the penalty of 20,000 euros, as it has already been taken over and confirmed by the court. Flink can still respond to that in the hope of changing the city council’s mind.
It is not yet known when the darkstore will close.
