The Basque Competition Authority sanctions two companies for a collusive agreement in public tenders of the Bilbao City Council
The Basque Competition Authority (LEA/AVC) has adopted a sanctioning resolution for which he fined two companies in Bilbao. The infraction, classified as very serious, has its origin in a collusive agreement in the tenders for the contracting of the service of design, preparation and distribution of advertising and communication elements for the cultural programming of the Area of Culture of the City Council, from the 2015 tender to the 2020 tender. The sanctioned companies have been Emociona Soluciones Creativas, SLL and Printhaus, SL, fined €11,503.49 and €25,896.25, respectively.
Now both companies must justify to the LEA/AVC Investigation Directorate the payment of the imposed fine and full compliance with the resolution within a month since its materialization.
In addition, offenders have been imposed the behavioral obligation to implement separate programs of compliance before June 30, 2023, and a copy of each of them must be sent to the Research Department. The companies, in addition to acknowledging the facts, have already begun the procedures to establish an action protocol “that already contributes to preventing the commission of new infractions within them through the preparation of these programs.” Said commitment has motivated the advisability of not imposing a ban on hiring on the companies in the file.
