The Administrative Court of Lyon welcomes the reduction of its deadlines

It is a positive assessment that the administrative court intends to present this Friday, October 14 during the annual solemn hearing.
The administrative court of Lyon draws up a positive assessment of the year rendered from September 1, 2021 to August 1, 2022, with in particular an overall drop in litigation requests and a deadline for processing cases respected. Geneviève Verley-Cheyne, president of the administrative tribunal since 2019, is delighted with the drop in litigation figures: “The curve of our figures shows that we are working well. We are proud of the trial times, since nearly 50% of our cases are processed in less than six months.“In comparison, the national average of files processed in less than six months is around 40%.
Of the 10,018 cases registered, the administrative court of Lyon manages to judge 9,858 cases, i.e. “only 500 files processed late in the year” for the president. The latter is also part of one of the most important in France, behind the courts of first instance of Paris, which record the most contentious cases.

As a reminder, the administrative court only deals with cases that deal with disputes between public persons (State, local authorities or public establishments), as well as disputes between a relevant person in the private sector against a public person. Among the many cases registered, the administrative court plays a role in litigation concerning the liability of public persons and hospitals, decisions in matters of town planning and the environment, in social litigation which affects all housing allowances, the RSA , certain decisions of Pôle Emploi, also in tax litigation and affecting foreigners.
An increase in refusals of foreign litigation
Litigation relating to foreigners remains the most processed matter at the Administrative Court of Lyon and represents 41% of cases (half concern OQTFs). By way of comparison, civil service litigation comes in second place and represents only 13% of cases.
The number of people filed a request with the Lyon administrative court for a refused residence permit is increasing considerably at the Lyon court. Indeed, this year, the court received around 4,700 requests for foreign litigation against 4,000 in 2021. The reasons may be economic, or even “irregular situations that accumulate“, according to the president of the jurisdiction. Even if the number of requests increases, the administration has found a “good balance and good organizationto resolve disputes within the expedited timeframes. Timeframes also vary depending on the case and can be 96 hours, and up to three to four months.
Tax litigation is doing well
At the same time, the administrative jurisdiction of Lyon recorded a drop in requests in terms of tax litigation. In 2016, 980 requests were registered compared to 500 in 2022.”The tax administration has managed, through prior appeal and conciliation procedures, to limit referral to the judge. It is quite easy to dialogue with the tax auditor. Today, it is an administration that has taken matters into its own hands. In the space of 10 years on one divided the number of requests by two“, rejoices the president of the administrative court.
The president will take advantage of the solemn hearing to present the newcomers to the administrative court, with three new chamber presidents, three first advisers and six magistrates. A 39th lawyer will join next January.
