They disfigure their victims in a parking lot in Monaco: a year in prison for the brawling duo
Never again such disorder in the Principality! This is the warning from the criminal court sent to potential troublemakers who would like to do battle on Monegasque territory. To fulfill the message, the judges sentenced two brawlers aged 28 and 23 to eighteen months in prison, including one year, freedom of probation for twenty-four months, obligations of care and compensate the victims.
The two defendants were compared, this Friday at the flagrance hearing, for having acted in extreme violence when leaving a night establishment on the route de la Piscine. Back to the facts dating back to last Wednesday.
Lesions, a broken nose and a coquard
Two friends, from Beausoleil and Villeneuve-Loubet, spent the evening on Port Hercule. They emptied several glasses of alcohol…
Around 3:30 a.m., they decide to go to the Antoine-Ier car park. At the toll, before returning to their vehicle, they attacked three young people. Apparently for no reason! Particularly violent since soaked in alcohol, they attacked and struck violent punches, especially in the face of their victims who escaped with lesions, a broken nose and a coquard, plus eight to twelve days from ITT.
Alerted, the police quickly arrested the two provocateurs, placed in police custody.
At the hearing, President Florestan Bellinzona imposed viewing of the video surveillance recording. “This is unacceptable behaviour. While one belts his prey and strangles it, the other kicks…”
“It’s unbearable to watch”
The filmed scenes provoked cries of horror, pain and compassion among those present in the courtroom at the carnage displayed on the screen. “These images bear witness to the violence and sufferingreacted Me Arnaud Cheynut, lawyer for the civil parties, endured by my three clients. They are there to express this dramatic situation which shocked them. It is disturbing to have to show the video to the defendants so that they realize their fault, their damage. On an apology! But we must take responsibility for this gratuitous aggression. Quantify the damage temporarily suffered: 4,500 euros in total. As for the sentence, you will appreciate for incredible facts in Monaco.”
In view of the seriousness of the acts, the requisitions of the first substitute Julien Pronier are both poignant and severe. “One of the victims courageously put his life in danger to stop, to protect! But we have the example of what nature, more bestial than human, can do worse. It was not punching bags where the defendants, fans of combat sports, are used to hitting. It is surprising and unpleasant to suffer such violence in the Principality where one feels safe. Even at 3 a.m. Blows with fists, feet, elbows, knees, strangulations… It’s unbearable to watch, to listen to the pleas of the victims who ask you to stop their ordeal because they didn’t strike a blow. You didn’t hear anything…”
shame and regret
The floorman’s face, tense and threatening, stared at two people in the room in order to reprimand them with a raised voice. “We can wonder about the complicity of their girlfriends who filmed the scene with their cell phones and spoke words of encouragement. The games of the ring, we do not practice them outside the ropes. You will sanction this fight without opponent by a common sentence for the two defendants: eighteen months in prison.
My Grégoire Gamerdinger and Maeva Zampori will however do everything to avoid the incarceration of their respective clients. They highlighted the importance of targeting where the altercation erupted, why the discussion turned violent and where the blows were exchanged.
“It’s because of the alcoholinsisted the lawyer. My client was shocked at what he was able to do. He had never been talked about before. A firm sentence would risk breaking the social bond with society. Split!”
For the lawyer, “The loss of reason tripped this young Beausoleil resident. He panicked! Listen to his feelings of fear, of regret: he did not watch the video because he is ashamed of his behavior. The penalty, if it is necessary, it must be instructive and effective. Prefer a suspended game.” The court will complete its conviction with medical expertise and the payment of sums totaling 4,000 euros for the civil parties pending the referral of the case on civil interests.
