However, some pubters openly reject the obligation to check vaccination certificates, despite the threat of up to millions. They say they cannot “check the health” of guests because it would violate the constitution and other laws. In addition, according to the Chcípl PES initiative, the measures announced under the Ministry of Health by Adam Vojtěch (for YES) use the same sentences that the Administrative Court (SAC) has ruled in the past to be in conflict with the Supreme Law.
With the autumn, a significant reduction in services came again after a few months. However, some of the affected restaurants decided not to comply with the regulations of the Ministry of Health. According to them, they are in conflict with the law, so they do not want a confirmation of inspection. Unvaccinated people are also invited inside. The Ministry considered the obligation to check the infectivity of guests as early as the spring of 2020, but then abandoned it. Today, in fact, the only ticket to a restaurant is vaccinations, or a covid.
One of the Moravian restaurants refuses to inspect the guests, stating that he is not authorized to do so: “No one in our company is authorized to inspect your health, he is not a hygiene employee and he is no longer your attending physician. If they have checked your state of health, we are committing an illegal act in accordance with Section 328 of the Criminal Code and thus we are subject to criminal prosecution. “
According to the restaurant, all regulations are by-laws and everyone, by entering the establishment, honestly declares that “he has no symptoms of infectious disease and is not aware that he would come into contact with infections.” That’s enough for her. Several other restaurants throughout the country are defending the same arguments. According to them, the measure is in conflict with the constitution.
Other restaurants in southern Bohemia also refuse inspections. Right at the entrance of each one, he will serve the unvaccinated, vaccinated, with and without a test. “Dear customers, you will all be served by us. We have food for the hungry, not for the elect! We are a free restaurant in a free country, “it says at the door. The restaurant was not afraid to express its opinion publicly on social networks.
Part of the restaurant then took the measures more recessively. One of the innkeepers pasted his own regulations on the door of his restaurant: “If the unvaccinated, ie. clear discrimination, I hereby issue my own regulations: Prohibition of entry by the Police of the Czech Republic and hygiene. My house is my castle.”
According to representatives of the Chcípl PES initiatives, customer inspections deal with discrimination. About 400 operators joined the initiative two weeks ago and refused inspections. The initiative also wants to take to the streets on November 17 in cooperation with other organizations. He wants to present his plans on Monday (November 15).
