Haščák’s villa in Hřebenky: Prague is considering an appeal
“At the moment, I cannot say more than that we will address this problematic issue in a coalition. One of the possibilities is certainly the city’s appeal against the demolition order issued by Prague 5, “Said Hřib. According to the mayor, the house in the Na Hřebenkách district, which was built as a residential builder by Viktor A. Beneš, is architecturally significant, although it is not listed. “I was very surprised by the demolition plans of the owners of the building, because according to my information, the previous request to change the zoning plan in this locality was connected with the assumption of the reconstruction of this house,” added the mayor.
“A petition will also be published on Wednesday, which will be required for the villa to be granted monument protection. Even public pressure could help in this case, “Alena Janďourková from Prague 5 told Blesk to herself
Andrea Holasová, a spokeswoman for the National Monuments Institute, said that she did not like to see the case, but they could not do anything about it. “It is about respecting the owner’s property rights and the current legislative framework in which we can operate. The proposal for demolition came to our table in mid-April, and on May 6 we issued a written statement pursuant to Act No. 20/1987 Coll., On State Monument Care, which allows for a statement other than accepting demolition, ”Holasová explained for Blesk.
The demolition assessment was issued by the Prague 5 Building Authority on 9 July. It is possible to appeal against it within 15 days from the delivery of the decision. By law, the capital is the so-called party to the proceedings, who can file an appeal. Prague 5 would be one of them only if it owned land around the building, which is not the case. According to the deputy mayor of Prague 5, Lukáš Herold (ODS), the city council will therefore probably call on the capital to appeal on Wednesday. He added that a possible outcome of the extraordinary meeting of the council could also be the intention to file an initiative to grant monument protection either for the villa or the whole area.
The Ministry of Culture is also interested
“It is necessary to find out all the necessary information with regard to possible rights acquired in good faith and then determine what to recommend, “Petra Hrušová from the press department of the Ministry of Culture told ČTK on Thursday. Prague 5 said on Wednesday, asked the city council to appeal against the demolition decision. The city district, unlike the capital, is not a party to the proceedings and cannot appeal.
Prague 5 says that the building authority had no choice but to allow the demolition, because the owners provided all the necessary opinions and the building is not listed. The house of an important Prague builder of the first third of the 20th century stands just outside the Smíchov monument zone and does not enjoy any monument protection in addition to the protection zone of the Prague Monument Reserve.
The Ministry of Culture is to follow the deadlines under the Administrative Procedure Code when declaring proceedings, but in practice these proceedings often take months to years, sometimes taking a very long time before the proceedings themselves are initiated.. However, after the commencement of the procedure for declaring a cultural monument, the real estate is covered by the protection corresponding to that which it would have if it had been declared a monument. The owner can not only demolish it without permission, but also repair it.
The owner of the villa Haščáková Diary N she wrote on Friday that she was selling villas and the new owner wanted to build another family house in her place. The procedure of the owners of the house was criticized by the chairman of the municipal committee for territorial development Petr Zeman (Prague Sobě). Last year, the committee recommended a change to the zoning plan allowing the villa to be used for residential purposes, but according to Zeman, it did not have information about the demolition of the buildings.

“When the change in the zoning plan is considered, I will definitely not agree with it and at the same time I will ask for support from my committee colleague. “ wrote Zeman on his Facebook profile. No change is required for demolition, but its approval will affect what may be possible to build on the plots. Changes to the zoning plan are finally approved by the plenum of the Prague City Council.
