TS confirms 11 years for breaking a sentence to rape his ex-wife in Bilbao

The Criminal Chamber has issued a sentence, to which EFE has had access, which rejects the appeal of the convicted person against the resolution of the Provincial Court of Bizkaia for a crime of sexual assault with the aggravating circumstance of kinship and another of breach of sentence .
In addition to the prison sentence, the Supreme Court ratifies the prohibition to approach or communicate with the victim for 15 years as well as compensation of 10,000 euros.
The man had already been sentenced in 2011 for crimes of threats and mistreatment and lack of injury, to the penalty, among others, of approaching and communicating with his ex-partner for four years and five months, being perceived the consequences of non-compliance. Of course, the man had the guard and custody of the couple’s daughter, with a visitation regime in favor of the woman.
The events occurred around 11:00 p.m. on July 7, 2012 when the man, “with knowledge of the content of the criminal decision and voluntarily and consciously,” appeared at the home of the protected victim, with their common daughter. two years old
Then, the woman opened the door thinking it was someone else and seeing that it was her ex-partner tried to close it to prevent him from accessing, but he gave her a strong push, throwing her against the wall. Then he locked the door and grabbed her hair and her arm, forcing her to duck and shoving the girl’s cart into a room.
Next, he searched the house, dragging his ex-wife to the kitchen, where he took a knife and with the intention of frightening her, told her “today I have come to kill you and kill the girl because you have left me without papers and I have left my wife there.” pregnant and because of the complaints you have made against me, I cannot be here or return to Morocco.
In that intimidating climate, under the threat of a knife, he grabbed her and hit her from behind to rape her in the presence of her daughter.
Shortly after, the woman managed to get hold of the “bortxa” victim assistance device by alerting the police through a missed call until an Ertzaintza patrol showed up in the vicinity of the home.
Immediately afterwards, the agents called the house from the portal, and when the condemned man looked out of one of the windows, the victim took the opportunity to quickly leave the house.
It was then that the agents broke the door in fear that the girl, who had stayed inside in the company of those – who did not want to open the door – could suffer any harm. Before the officers finally entered, the man fled by jumping out of the kitchen window.
