Monday December 20, 2021, shortly before 8 p.m., an accident occurred on the outer ring road north of Caen (Calvados), at the Côte de Nacre exit. The driver of the car hit, transported in absolute urgency to the nearby University Hospital, died the next day. The driver of the vehicle responsible for the collision, a 37-year-old woman, appeared before the Caen Criminal Court on Tuesday, November 29, for manslaughter with two aggravating circumstances: alcohol ingestion and excessive speed.
Three whiskeys and cokes before hitting the road
We are a few days away from Christmas. Lucie* has gone to her last lessons when a friend calls and asks to see her. When she leaves her house, the young woman has drunk three whiskeys and cokes. She is in a hurry because she does not want to be late for an appointment. On the northern outer ring road, she is driving too fast. It is dark and there are works. She hits a vehicle with such force that the car is thrown away. The 50-year-old driver dies the next day. The police findings showed that Lucie had 1.20 grams of alcohol per liter of blood, and that his speed was 118 km/h. Liberal nurse, she will be suspended by the council of the order.
At the bar, Lucie is in tears. She evokes a “deep sorrow”, asks the family for forgiveness and confesses her immaturity at the time. The young woman was accustomed to multiple minor speeding and had already been checked with a blood alcohol level beyond normal.
The prosecutor observes that this tragic accident is not bad luck. “Nobody held his hand to drink those three whiskeys and nobody put his foot on the accelerator.” He requires a four-year prison sentence, including one year, as well as the cancellation of the driving license suspended for one year during the accident.
Three years in prison, including a farm
The defense pleads for clemency for this woman who is not a habitual offender, who has lost her job and is wracked with remorse.
Lucie is finally sentenced to three years in prison, one year of which is firm.
She will also have to reimburse 7,384 euros in hospitalization costs and 500 euros in lump sum compensation. His license is canceled with a ban on retaking it for one year. It will also have to compensate the family of the victim at a level which will be fixed in June 2023.
