Rouens. Six months in prison for alcohol and cannabis in recidivism at the wheel

A man was sentenced to prison by the Criminal Court of Rouen (Seine Maritime), Friday, November 18, 2022, for numerous repeat traffic offences.
It all started in March 2022, when the gendarmes, as part of a road safety operation, decided to check a vehicle. The driver is uninsured and comes out positive for narcotics. The gendarmes also discover that the individual has been under license suspension since February 2020. Arrested and heard, the driver acknowledges the facts and explains that he had to pick up his son and had consumed cannabis the day before. A summons to court is then given to him.
But four months later, the driver is checked again, he is still under the influence ofa suspension of license, without insurance and under narcotics but this time the man also drives in a state of intoxication. Again heard, he explains this time, to have gone to look for parts so that his car can receive a favorable opinion at the technical control. A new summons to court is issued to him by the gendarmes for November 21.
In immediate comparison
But on November 16, 2022, the latter was again checked by the police on board his company’s vehicle without having the right to drive it and still under the influence of cannabis. Arrested, this time, the man is taken into custody. He explains that he had to “go to the recycling center to evacuate hazardous waste for his children”. For the public prosecutor, this is one offense too many. He decides to cancel his summons to court and to continue in immediate comparison.
In the box, the defendant consented to his statements and acknowledges all of the facts with which he is charged, but displays a detached and nonchalant attitude. The criminal record of the latter does not plead in his favor: five mentions, all for traffic offenses.
“You can go to jail tonight”
Asked about the reasons for this series of traffic offences, the man adapts his answers to each question from the court, sometimes providing contradictory answers. Faced with his attitude, the president is ironic: “It’s hard to row Sir! “. The defendant tries to convince the court that it is “exceptional conduct” but the president does not believe it: “So exceptional, that we find you four months later, still driving and under cannabis but this times with alcohol, it will have to stop! »
And the public prosecutor’s bid: “It’s time for you to understand that for traffic offences, you can go to prison tonight”, which, moreover, joined the word to the act by asking for a 10-month sentence. imprisonment with warrant of committal and cancellation of driving license with prohibition to retake it before a period of one year.
Counsel for the defendant denounces “extremely severe requisitions”. If he understands that his client’s attitude may have annoyed the court, he points out that the sentence is totally “disproportionate”. In order to avoid the case in prison, the defendant’s lawyer pleads his total recognition of the facts and assures that his client “has become aware that he must stop his actions”. He reminds the court that his client is perfectly integrated socially and professionally and is asking for a sentence “that makes sense” without incarceration.
Six months imprisonment
The court found the defendant guilty as charged and sentenced him to a six-month prison sentence which he will carry out under an electronic bracelet. In addition, he getsa fine of 200 euros and his driving license is canceled with a ban on retaking it before a period of four months.*
