The indestructible Monique Iborra therefore remains MP (Renaissance) for Haute-Garonne until 2027. Thursday, September 22, 2022, the constitutional council made public her decision, endorsed the day before in session, following the request made by Fabien Jouve, ex-rival son (Nupes-PS) of the Legislatives, in the 6e constituency of Haute-Garonne, where the outgoing 77-year-old was re-elected by a hair’s breadth last June. But uncertainties hovered around this remedy since the brutal deaththis summer, the municipal councilor of Colomiers, victim of a devastating illness at the age of 44.
Fabien Jouvé had been beaten… by four votes
Recall that on June 28, nine days after the second round, the Constitutional Council had been seized of a request presented by Mr.e Philippe Bluteau, Fabien Jouvé’s lawyer, tending to the cancellation of the legislative elections in the 6e constituency, which covers Colomiers, Tournefeuille, and the west of the agglomeration of Toulouse.
Fabien Jouvé, who challenged his ex-socialist comrade who became Walker Monique Iborra, had been beaten… by four votes (after recount). Out of a total of 115,000 subscribers, this tiny difference of four votes in favor of the outgoing had been – as often, in such cases – challenged in court.
Faced with these results “particularly tight with a difference of four votes out of more than 55,000 votes cast”, the unfortunate candidate of the Nupes then observed that “the vote counting commission reported by an independent magistrate” had carried “a greater number of abnormalities out of voice”. “Let the judge decide”, had retorted the majority member, confident in the outcome of the procedure.
But less than two months later, the death of the elected Columérin, also a community adviser in Toulouse Métropole, was pronounced.
The death of Fabien Jouvé renders “his request pointless”, notes the council
The Constitutional Council, which relies on article 59 of the constitution and the electoral code, indicates that the death of Fabien Jouvé renders his request “pointless” brought before the Sages.
“Mr. Fabien Jouvé died on August 17, 2022. Due to the personal nature of the action in electoral matters, this death renders his request pointless. There is therefore no need to rule on it”.
A member of the National Assembly’s Social Affairs Committee, Monique Iborra is involved in a 4e mandate at the Bourbon Palace.
