Arbeidsliv, Haver Advokatfirma AS | Local lawyers received a European award
The Personal Injury Lawyer of the Year award was handed out in Copenhagen just before the weekend, and the recipients are the two lawyers at Haver’s law offices in Bryne and Stavanger.
It is the European Association of Personal Injury Lawyers (PEOPIL) that distributes the award, and in its justification the jury points to the Norwegian Supreme Court judgment from 8 June this year, in which Carl Aasland Jerstad and Linda Egeland won full force for their client. The so-called American is about a child who was injured during birth in Norway, but who after a few months moved to the United States with his Norwegian mother and American father.
The crux of the case was whether the child was entitled to compensation for care expenses based on the level of expenses in the USA, which is much higher than in Norway. The Supreme Court ruled that it should be, and this leads to an additional payment of several tens of millions of kroner to cover the expenses for the child.
The judgment opens the way for people who injure themselves in Norway, but who do not live or will live in Norway, to be awarded compensation based on the conditions in their home countries.
Both Carl Aasland Jerstad and Linda Egeland are partners in Haver Advokatfirma AS, and both have the right to appear before the Høyesterett.
