In Luxembourg – Non-payment of alimony, an important phenomenon?

LUXEMBOURG – 95 people have been sentenced in the past five years for failing to pay maintenance for more than two months, the government says.
This is called family abandonment: 95 people have been sentenced in the past five years for not having paid alimony for more than two months. This is indicated by Corinne Cahen, the Minister for the Family, in a parliamentary response. In detail, there were 27 convictions in 2021, 18 in 2020, 14 in 2019, 16 in 2018 and 20 in 2017.
On the other hand, the government does not have statistics on unpaid alimony. “To recover arrears of maintenance payments, creditors can use all the judicial and extrajudicial means of execution at their disposal,” explains Corinne Cahen. With regard to judicial enforcement proceedings, it is not possible to distinguish the following cases from the nature of the claim”.
It should be noted that there is a system of advances on alimony intended to help financially people who have exhausted, without success, all legal means (law of July 26, 1980). Is this system protective enough for the beneficiaries? Asks CSV MP Diane Adhem. The Minister replies that a revision of the law in question is not on the agenda.
