New municipalities: the difficult union commitment
One could imagine that the creation of new communes induces the union commitment of worried agents. This is not the case, if we are to believe Monique Percept (SE), mayor of Mosnac-Saint-Simeux (8 agents, 1,000 inhabitants, Charente), an entity born in 2021: “The merger has not worried the agents, because we took what was best for them in each municipality, ”she says. Issue of social dialogue

In Porte-de-Savoie (40 agents 3,600 inhabitants, Savoie), born in 2019, the CDG is on site, but the DGS, Sylvie Selleri, did not want to be content with consultations with the technical committee (CT), because none of its agents sit there. “Aided by a consultant, we conducted workshops, internally, on the organization chart and management guidelines,” she explains. In L’Aiguillon-la-Presqu’île (60 agents, 2,700 inhabitants, Vendée), the mayor, Jean-Michel Piedallu (SE), is delighted that his entity, created on January 1, exceeds the threshold of 50 agents inducing the creation of a CT (read below): “It’s important for a real social dialogue, believes this former trade unionist. But the agents must mobilize. Or, there again, the call for applications is far from having aroused enthusiasm. He therefore argues and hopes: “Perhaps it takes time for them to recognize each other as colleagues…”
Majority organization
But in Annecy (3,300 agents, 130,700 inhabitants), yet the first new municipality created in 2017, the question of the participation rate still arises. While it was 47.2% in 2014 for the “historic” Annecy CT, it fell to 36% in 2017 and was 39.5% in 2018.
“A very majority organization, Unsa, has emerged, but it is on less than 40% of voters”, regrets Christophe Ferlin, deputy director of human resources, in Annecy. For this reason, and because “relations have become strained”, he wants to encourage more agents to vote on December 8. “There are so many subjects to deal with in a new municipality, he comments, that you have to be able to co-construct with the unions. »
Threshold effect for the technical committee
If the workforce of a new municipality reaches or exceeds 50 agents, it must set up a technical committee. Those created recently must wait for the professional elections in December, since the establishment of a TC is, in principle, no longer authorized two years and nine months before a general renewal of the authorities, ie since last September. Consulted in 2021 by the prefect of Morbihan on the case of a new entity which wished to install it without delay, the management center (CDG) of this department recalled this rule. “However, notes Jean-Louis Le Pabic, jurist of this CDG, seized in December by the prefect of the Vosges on another case, the general management of local authorities authorized such an election.
