he denounces his unworthy prison conditions and obtains a release
Presence of cockroaches, rats, bugs, 10.7 m² cell for three people… Such were the living conditions of a 30-year-old inmate from Seysses prison. In pre-trial detention since February 5, 2021, the detainee presented before the judge of freedom of detention, on December 17, two interim procedures, initial by Me David Nabet-Martin and Me Marine Saurat, in order to obtain release. .
The release was ordered on the basis of guarantees of representation. The judge noted that there was indeed a condition of indignity and gave the penitentiary center a month to put in place corrective measures “, assures Me David Nabet-Martin, lawyer of the detainee, questioned by The Independent Opinion.
Indeed, last July, the Seysses prison was pinned for “dirt and violence”, according to a new report from the general controller of places of deprivation of liberty, Dominique Simonnot, unveiled by the Chained duck.
The release procedure was subsequently submitted to a call from the prosecution. While waiting for his case to be processed again before the investigating chamber, the detainee once again faced deplorable prison conditions. “The cell was infected with cockroaches and a window was broken … in the middle of winter”, lament me David Nabet-Martin.
Freedom under judicial control
Thursday, December 30, 2021, before the magistrates of the investigative chamber of the Toulouse Court of Appeal, Me David Nabet-Martin once again reported on the conditions of his client’s detention and argued in favor of placement under judicial supervision.
This Monday, January 3, the detainee informed that his request for release had been accepted, after 10 months spent behind bars. “Since Tuesday, January 4, my client has been placed under electronic surveillance,” says his lawyer. He continues: “The conditions of detention, but also the progress of the investigation which relieves him of his guilt allowed him to obtain his release. The investigation is still ongoing, but he should, very likely, be cleared in the coming months. ”
