Sira Sylla’s parliamentary attachés take legal action for moral harassment
Sira Sylla, LREM deputy for Seine-Maritime, is in the crosshairs of several of his former parliamentary attachés. Some have seized the labor courts of Rouen and Paris, other cases are in progress. Update on this case.
This is her first mandate, a source of pride for this Norman, originally from Saint-Etienne-du-Rouvray. Elected in June 2017 in the 4th constituency of Seine-Maritime, this LREM deputy is still in the crosshairs of several parliamentary attachés with whom she has collaborated.
Since her election, this lawyer by training has changed more than fifteen collaborators, a number much higher than the average. Some of them denounce moral harassment on the part of the young deputy, it is our colleagues from the Elbeuf newspaper who publish the first testimonies.
According to our information, they are at least three to have brought this case before an industrial tribunal. Two parliamentary attachés did so in Rouen, and a case was investigated by the Paris court. It mainly involves declaring moral harassment, non-payment of overtime, non-compliance with the rules of the day package but also a dismissal without real and serious cause.
A colleague of the deputy, concerned by this moral harassment, evokes incessant messages from the part of Sira Sylla, excessive hours, unpaid overtime. He speaks of a permanent stress, of an ambivalence of the attitude of the politician towards her work. This young parliamentary attaché explains: “What destroyed me was the duration of the harassment, one week I was the most bad, the next, I was the most beautiful.”
I did not see that I was in a situation of harassment, it was my relatives and my doctor who realized it. I no longer speak, I was no longer laughing. I had several sick leaves for depression. I am still very anxious since.
“Martin” – Former parliamentary attaché to Sira Sylla
Last January, before the Paris industrial tribunal, a former parliamentary attaché to the Normandy deputy will win her case on all her demands. These included the payment of overtime, his dismissal without real and serious cause or the recognition of a situation of moral harassment. For this last point, his employer Sira Sylla must compensate him up to 15,000 euros in damages.
One of the injuries, which had seized the industrial tribunal of Rouen, saw its applications rejected in August 2021. Dismissed for professional insufficiency, this former collaborator of Sira Sylla argued, among other things, a problem of moral harassment, she deplores before the prudhommes council “Calumnies on her intellectual capacities, intimidation on the part of Madame Sylla.”
She maintains that the member kept phoning her late, waking her up in the middle of the night. “
Judgment of the Rouen Labor Court
If the court says that certain elements transmitted without delay “question on the exercise of the employment relationship (schedules, intimidation e-mail) the elements in the file do not provide proof of a demonstrated moral harassment.” This ex-collaborator did not wish to appeal.
Another case is already in the hands of the Rouen industrial tribunal, a third case which should be the subject of a hearing in the coming months.
Contacted by phone, the deputy Sira Sylla did not answer, and as for his lawyer, he does not wish to speak.
