Hanover / Lüneburg (dpa / lni) – Legal action is being taken against parts of the so-called Christmas rest in Lower Saxony. “We support an event company near Aurich with a norm control application against the dance ban at Christmas and New Year’s Eve,” said the managing director of the Lower Saxony hotel and restaurant association (Dehoga), Rainer Balke, on Saturday. The application was sent to the Higher Administrative Court (OVG) Lüneburg on Friday.
Lower Saxony’s state government has announced a so-called Christmas break for the period from Christmas Eve to January 2. Warning level 3 should then apply nationwide, with the corona rules being tightened again. Among other things, dance events are prohibited, test requirements are tightened and the number of permissible contacts is reduced. The NDR had initially reported on the action against the dance ban.
“We now hope that the government will comment quickly on the impending dance ban and that there may be a court decision on this before Christmas,” said Balke. According to a report by the Bremen “Weser-Kurier” on Saturday, a private person also appeals to the OVG with an urgent application against the restrictions caused by the flat-rate declaration of warning level 3 between December 24th and January 2nd.
It was only on Thursday that the (OVG) Lüneburg overturned the already valid 2G rule in retail. The judges justified the decision that the measure is not necessary to further contain the coronavirus and is not compatible with the general principle of equality. For this reason, new rules are to be introduced for dying businesses in the coming week.
The planned dance ban is a disaster for many event companies in the country, said Dehoga boss Balke. The measure led him to the fact that order books were still well filled at the end of October, are now empty again. That is why it is so important that there is a judicial decision on this before the holidays.
