Prize competitions, lotteries and raffles during the Christmas period in San Marino: a specific request must be made to the State Games Authority
On the occasion of the upcoming Christmas holidays, with the consequent increase in the organization of prize competitions, lotteries, raffles and the like, the State Games Authority of the Republic of San Marino reminds you that anyone who intends to organize and manage on an occasional and not in stable form a single game, prize competitions, lottery, games of chance and skill for which a prize is up for grabs in the context of both public and private events also connected to business or commercial initiatives, as per article no. 4 of Law no. 67, must make a specific request to the State Games Authority.
This request can be replaced by a communication to be made at least 15 days before the start of the game only if the expected gross introduction is less than 500 euros, the prize pool is less than 5,000 euros, the organizer is a San Marino economic operator. and the game is played for promotional purposes (category H of the Delegated Decree 169/2014, prize competitions and similar exercised for promotional purposes). The “games” are all authorized and therefore do not fall within these characteristics. In the case of “game” with authorization, it is necessary to present a specific request to the State Games Authority, attaching the game regulations, no. 1 revenue stamp of 15 euros and the criminal certificate of the person who will be indicated as responsible for the game; these games are subject to a special fiscal setting in the amount of 12% on the gross introduction if with prize money exceeding 5,000 euros, and are always subject to supervisory charges in the amount of 2% on the gross introduction.
The “games” for which it is sufficient to send the communication are subject to supervisory charges in the amount of 20 euros for each draw. It should be noted that the exercise of any gaming activity in the absence of authorization and / or communication is sanctioned, even criminally, pursuant to Law 67/2000 and subsequent amendments.
