The case of “Yes Bulgaria-Union” against the refusal of the REC for registration has started
A three-member panel of the Administrative Court chaired by Judge Galina Dinkova for nearly two hours considered case 614 from 2021, introduced by “Yes Bulgaria-Union” against the refusal of the District Election Commission / DEC / to register the list of candidates in 27th constituency.
The court accepted the indisputable facts on October 12, together with a representative of the coalition, who was presented with an electronic document and an electronic list of lists exactly 45 minutes before the deadline and refused to use two witnesses.
The chairman of the REC in Stara Zagora Zlatina Yovcheva explained the arguments for refusing to register a list, which is supported by 13 of the 16 members of the commission – initially, an error was found – the name of the same candidate was repeated, second, Assoc. Prof. Atanas Slavov no has agreed to sign under the text “True to the original” of the paper version.
Zlatina Yovcheva clarified that there is no electronic register in the DEC in order to store an electronic document. This is the reason to include a paper version when registering the lists of candidates.
After the trial, Nadezhda Yordanova, a lawyer for Yes Bulgaria – Unity, a former MP, said that a technical error had been made and that the REC requirement was not explicitly provided for in the Electoral Code.
A review of the Administrative Court in Stara Zagora when choosing a case will be announced at 4.30 pm.
