The French Blood Establishment rejected in the face of a group of homosexual donors
The French Blood Establishment had referred the collective to Homodonneur, which campaigns for the blood donation of homosexuals, after several break-ins in donation centers. Justice has just dismissed the EFS.
The Toulouse Judicial Court dismissed, on October 14, 2021, the French Blood Establishment of all its claims against the collective Homodonor. The institution had assigned this Toulouse collective in summary proceedings for several break-ins in their premises and damage to the image of the EFS.
The Homodonneur collective only has about ten members, but it is very active on social networks and in the field. Its president Frédéric Pécharman regularly organizes peaceful occupations of the premises of theEFS in Toulouse and in the Occitanie region.
Nothing really bad! What pleaded in our favor is precisely the non-violent nature of our occupations. We do not hinder the smooth running of blood transfusions.
Justice recognized that there was no manifestly unlawful disturbance in these actions. The Homodonneur collective was prosecuted in particular for having, between September 2020 and September 2021, organized five break-ins in the premises of the French Blood Establishment.
Contacted, the French Blood Establishment says it does not want to comment on this court decision. A representative of the institution explains: “What matters to us above all are the blood reserves. The situation is tense and we are concentrating on collecting blood.“
The Toulouse-based Homodonneur collective intends to continue its actions, even if its fight is about to be won. In fact, in June 2021, the National Assembly voted an amendment to the Bioethics bill lifting the specific selection criteria for homosexual or bisexual blood donors. The law should apply from the start of 2022.
To donate blood, homosexuals must be abstinent for at least four months, which is not the case for heterosexuals.
A rule that was esteemed for the LGBT community. The government therefore asked parliamentarians to lift the length of abstinence required for male blood donors who have sex with other men.
