“He has been terrorizing his family and loved ones for weeks”: in Rouen, a condemned man

A man appeared on Tuesday, October 12, 2021 in court in Rouen (Seine-Maritime), accused of having between June and October 2021 multiplied death threats towards his older sister before attacking his ex-girlfriend.
On June 29, 2021, a woman came to the police station accompanied by her little brother to indicate that the latter had committed a burglary coerced by his second, 28-year-old brother. She explained to the police that she had received a call from her brother: “He was alcoholic and told me that he had just received a burglary in a grocery store”, before seeing him return with two bags. She also recounts having received a call from the second brother, asking him not to warn her grandmother. But when she tells him that it is already too late, the man loses his temper and threatens to “bleed her”. She continues her story by revealing that for some time now, her brother has called her constantly to insult her and threaten to attack her or her family.
“I know what he is capable of”
Heard, the younger sibling confirms his sister’s statements and assures that he acted under the threat of the big brother: “He told me that if I didn’t obey, he would kill me, I know what he is capable of. “Placed in police custody for this theft, he indicates that his brother would have threatened him with death” by miming a gesture of throat cutting and a pistol with his hands “.
The ex-companion of the threatening man also explains being the victim of death threats against a background of jealousy: “He told me if I see you, I will kill you. “She explains that a second episode took place while she was with her new boyfriend:” He threatened to kill us. “
Placed in police custody, the defendant acknowledges the vast majority of the facts with which he is accused, but qualifies the procedures as “a waste of time”. Brought before the prosecutor, he is placed under judicial control pending his comparison, scheduled for the end of December 2021.
But on October 9, 2021, the older sister shows up again to file a complaint against her brother. She accuses him of malicious calls and death threats. She told the police that her brother contacted her on the phone several times: “He was drunk as usual, and insulted me before threatening to burn my house, my family, my children and me with it. “The victim explains that he fears an act on his part, to the point that she moved away following previous threats:” He has a heavy history of violence, I no longer dare to leave my home. “
Through a recovery of proceedings, the police uncover previous complaints filed by the same victim for death threats committed in August and September 2021.
“Every day she files a complaint against me”
Arrested in a hotel in Saint Etienne du Rouvray, the man is again placed in police custody. He admits being under judicial supervision and having attacked his sister under the influence of alcohol: “She called me, I had not slept all night and I was tired. This time the prosecutor decides to have the respondent appear for immediate comparison.
It is under these conditions that the accused is in the box. Very easily, he recognizes the facts while competing having forced his brother to handle a break-in at a grocery store and threatening to kill him. He explains his acting out by “strained” relationships and by his chronic alcoholism: “Every day she files a complaint against me for a yes or a no. “” Your words are extremely violent “, reminds him the court, but the defendant seems to trivialize the seriousness of his words:” Yes, it was in anger, I was alcoholic, I am not a bad man. “
Absent at the hearing, the victim becomes a civil party through his lawyer and recalls that despite a serious warning from the courts, the defendant reiterated his criminal acts: “It is a common practice for him to insult and threaten her sister. He explains that his client is terrified and suffers psychologically from these permanent attacks, and seeks the sum of 2000 € in damages.
For the public prosecutor, the defendant does not hear the repeated warnings of justice: “Under judicial control, he reiterates the same facts a month later. “He is sorry in front of the speech of the defendant” minimizing “the charges and worries” of a possible passage to the act “:” He has been terrorizing his family and loved ones for weeks, it must stop. He requires a 12-month prison sentence, including six months with a probationary suspension of two years, with the obligation to fix his residence, to take care of himself, to compensate the victims with provisional execution.
A “deleterious” family context
The accused’s counsel ensures that his client has assumed his actions by triggering “his explanations”. He wishes to remind the court of the “deleterious” family context and the chaotic life course “strewn with wandering and alcoholism” suffered by his client for many years. He is asking for an alternative sentence to imprisonment, in order to allow him to begin serious care and to be helped in a process of social and professional reintegration.
The court acquitted the accused of the death threats committed on his little brother, but found him guilty of the remainder and sentenced him to ten months ‘imprisonment, including six months’ imprisonment with a probationary suspension of two years. The convicted person will serve the closed part in the form of semi-liberty and will have to pay his sister the sum of € 1,000 in damages. *
