Lisbon Chamber awards construction of altar for 4 million through direct agreement. Exception to the law allows
The Lisbon Chamber signed, on January 13, a contract by direct agreement worth 4 million and 240 thousand euros for the construction of the Altar-Palco in the Tejo-Trancão Park, within the scope of the World Youth Day. The amount exceeds the legally established limit for direct adjustmentsbut one exception to the law included in the State Budget for 2023, which is solely and exclusively aimed at contracts signed within the scope of WYD, allows.
According to the Public Contracts Code (CCP), the direct award, a regime in which public entities contract directly from suppliers, without resorting to public tenders, is allowed for public works contracts and is limited to a maximum ceiling of 30 thousand euros.
However, article 118 of the State Budget for 2023 defines that “for the conclusion of contracts which have as their object (…) the carrying out of public works contracts and which are intended for the organization, programming, design and implementation of World Youth Day 2023 (…) the contracting authorities may adopt direct award procedures when the value of the contract for lower thresholds referred to in paragraphs 3 or 4 of article 474 of the CCP”.
In turn, article 474 of the CCP, created to define the “Amounts of the European thresholds”, makes the direct adjustment in question, since the possible limit for public works contracts is set at €5,350,000 .00 (five million, three hundred and fifty thousand euros).
According to the works contract signed by Lisboa West, SRU – Sociedade de Reabilitação Urbana, EM, SA and MOTA-ENGIL, Engenharia e Construção, SA, the deadline for carrying out the work is 150 days, counting from the date of consignment. The construction of the Altar-Palco in the Tejo-Trancão Park will cost more than 4 million.
It should be recalled that on January 19, the Lisbon City Council signed a medium and long-term loan, up to the amount of 15.3 million euros, to finance investments within the scope of the World Youth Day.
In a private meeting of the executive council, the proposal was made possible among the 17 elected, with one vote against BE, nine abstentions – four from the PS, two from the PCP, two from Cidadãos Por Lisboa (elected by the PS/Livre coalition) and one from the Free – and seven votes in favor of the “Novos Tempos” coalition (PSD/CDS-PP/MPT/PPM/Aliança).
The proposal will still have to be awaited the vote of the Municipal Assembly of Lisbon.
