May 9, single or double holiday?
In 2024, Europe Day and Ascension Thursday will fall on the same date. But already the issue preoccupied at the highest level of the state.
This year, the question does not arise. count 2023 11 public holidays, on different dates. But, coincidence of the calendar, this will not be the case in a year. Fr 2024, a “black thursday” is announced for the month of May.
Indeed, the May 9, 2024a civil celebration and a religious holiday will collide: the europe day on one side, the Ascension Thursday the other. As a result, the question of managing compensation or rest days will have to be decided.
And the problem did not escape the Luxembourg deputy, Marc Spautz (CSV) which has just challenged the Minister of Labor on this subject. The problem already promises a lot of headaches for the minister George Engel (LSAP).
Christmas and New Year’s Day to catch up
Has he ever held discussions on this paradox with the social partners, questions the parliamentarian. We imagine that employers and unions will not have the same vision of things. Will this day count single or double at the level of the allocation of holidays? The dilemma is posed and will have to be decided in the next few weeks.
As it stands, the Labor Code has not revealed such a scenario. It is true that the Europe Day holiday has not become part of Luxembourg’s customs that since 2019.
Thereby, the current rules on rest and the remuneration to be granted to employees as apprentices concern “only” public holidays falling on a Sunday, a working or non-working day normally worked or not. With this precision to know: the increases given for the work performed, legal public holidays are exempt income tax.
Incidentally, it is good to remember that a holiday falling on a non-working day requires the employer to grant 1 day of compensatory leave to the employees concerned. This concerned in particular Christmas 2022 and the New Year’s Day 2023 which are both fell on a Sunday…
The compensatory leave, in this case, is to be taken within three months.
