Press release majority forces
Yesterday, 21 December, the Repubblica Futura group, part of Libera and a member of the Mixed Opposition Group presented two amendments, the first additional to an article 2-bis and the second subordinately, which, if approved , will prevent the State from exercising civil action, i.e. requesting compensation for damages, clearly if damaged, in the event of criminal proceedings opened against journalists for facts committed in the exercise of their duties, thus revoking any civil action in ongoing proceedings. This majority reaffirms and claims the possibility of the State, like any other natural or legal person, to protect its integrity before the appropriate offices, being able to freely exercise the right of defense and adversarial, cornerstones of a democratic state. The majority strongly rejected this proposal as, from a formal point of view, it appears manifestly unconstitutional, while, from a substantive point of view, it would have constituted a license to defame the institutions, given that the Most Excellent Chamber would have been legally prevented from asserting their reasons in court, with serious damage to the image and assets of the State. The majority forces also reject as instrumental the ridiculous accusations of authoritarianism made by the opposition forces, which do not hesitate to spread lies of every sort to validate these rantings, even arguing that this council majority would have included the third party in the San Marino legal system to “save” the defendants of the so-called Conto Mazzini and which has never been seen in the history of a government that acts in court in the face of news deemed false. The first accusation dismantles itself: not only the defendants of that trial were not able to benefit from the recently introduced third degree of judgement, but the same forces of opposition Libera and Repubblica Futura had, in their government program, the introduction of the same third degree of judgement. The second is equally denied by the acts carried out by Libera and Repubblica Futura during their government adventure, when they gave a mandate to the State Attorney’s Office to proceed with lawsuits even following press releases from opposition forces and when the Board of Directors of Cassa di Risparmio – appointed and supported by them – gave a mandate to a lawyer (who would later also defend members of Banca CIS) to sift through every public communication of the then opposition forces who denounced the disastrous, if not criminal, actions of the bank management now.SM , recently certified by the Commission of Inquiry. The majority forces, on the contrary, intend to strongly reaffirm their support for freedom of the press and speech, demonstrating as of now their willingness to introduce greater protections for information professionals affected by lawsuits devoid of any foundation and moves by intimidating intentions in the context of the Information Law which will soon have to be approved by the II Council Commission.
