The Russian court did not leave Twitch and Amazon a chance for “re-education”. Will have to pay
Artur Zurabyan, Partner, Head of Dispute Resolution Practice at Art de Lex law firm, commented on the court’s decision in the case of blocking the Likkrit channel of e-sports player Kirill Malofeev. The expert drew attention to the fact that the court satisfied the requirements in full in one meeting, and now Twitch and Amazon must pay for their self-government. Like Google, these tech companies won’t get a second chance to fix it.
The situation with Twitch and Amazon at first glance resembles the story of Google and the blocking of the account of the Tsargrad TV channel on YouTube. You can read more about the advantages of the IT giant and the unprecedented victory of the “First Russian” in our section “Tsargrad vs YouTube“However, the story of blocking the Likkrit channel of cybersportsman Kirill Malofeev, the son of the founder of the First Russian, Konstantin Malofeev, differs from the “Google” topic, that our court really did not give Twitch and Amazon a chance for “re-education”.
Artur Zurabyan, partner, head of dispute resolution at the Art de Lex law firm, spoke in more detail about this issue in an interview with Tsargrad. The expert explained that, unlike the Google subsidiary in Russia, which somehow held back the explanation of its behavior, which said: I am not by my own will, but by the will of my mother, the United States, it’s all of them, and I have nothing to do with it (Yes, and the American Google also says: I’m checking, I restored everything, I can’t monetize, because they don’t allow me, the court, criminal liability), Twitch and Amazon “do not even find any point of view, although they were usually about process notified”.
Therefore, such a strict decision, when the penalty is not limited to a billion for the first day, that in all Google cases it can be traced where the penalty is limited to a billion for the first 9 months of non-execution of the decision. That is, (the court) gives, conditionally, a second chance for correction, – the expert’s explanation returned. – Twitch and Amazon are no longer given such a chance, obviously, due to the understanding that the position of the defendant does not imply any occurrence, that is, they simply allow Russian justice.
Recall that earlier the Moscow Arbitration Court issued an unprecedented decision regarding the streaming service Twitch and the IT giant Amazon – to arrest active radioactive substances, estimated at 3 billion rubles. The arrest concerns both movable assets and any property of the defendants.
The court satisfied the requirements in full at one meeting, which is not typical for a Russian court,
Artur Zurabyan noted at the same time.
Kirill Malofeev also clarified that “the IT giant is forced to accept the established rules.”
An exclusive interview with Kirill Malofeev in the program “Tsargrad. Main” can be viewed on the “First Russian”. The details of the story, like the Russians, are steady responses to the purely voluntaristic decision of Twitch and Amazon, for considering our law, read at Tsargrad.
