“Chez Fritz” complaint dismissed – region
BUCHS – The administrative court supported the decision of the building and environment department and dismissed the complaint against the construction of the high-rise on the “Chez Fritz” site in its entirety.
The building and environment department of the canton of St. Gallen rejected the appeal against individual “Chez Fritz” planning decrees from the city of Buchs in January 2022. The appellant then appealed the decision to the administrative court of the canton of St. Gallen.
The decision of the building and environment department has now been “confirmed in full by the administrative court, and the complaint has been dismissed on all counts,” said the city of Buchs in a press release on Thursday. Accordingly, the court confirms that the city council formally carried out the procedures. In addition, the administrative court also confirmed that the “Chez Fritz” area is a particularly suitable location for a high-rise project from a legal point of view, fits into an overall planning concept and does not prejudice the planned overall revision of the local planning.
“The plans of the landowner, the decisions of the city of Buchs and the building and environmental department are all considered right by the administrative court,” emphasize those responsible. However, the decision is not yet final and can be appealed to the Federal Supreme Court. If this does not happen, according to the city of Buchs, the partial zone plan, the change to supplement the building regulations for the priority zone and the special use plan “Chez Fritz” will come into force. All that is then missing for the start of construction is a legally binding building permit.
