Jubular case: Cédric Jubular’s request for release rejected by the Toulouse Court of Appeal
Suspected of having killed his partner in December 2020 in Cagnac-les-Mines in the Tarn, Cédric Jubillar pleaded this Tuesday, October 11 before the Toulouse Court of Appeal for his release. A week later, the appeals court was once again denied his claim.
It was there sixth time that the lawyers for the 35-year-old plywood worker were asking for his release. Main suspect in the case of “the disappearance of the Tarn”, Cédric Jubular is in provisional since June 18, 2021.
This Tuesday, the judge of the Court of Appeal rendered his decision on this application for release. And the court proved that his continued detention is “necessary for the preservation of evidence and the continuation of the investigation”. The main suspect in the case, he was indicted for voluntary homicide in June 2021.
The conditions of release in the viewfinder
His trio of lawyers, Me Emmanuelle Franck, Me Jean-Baptiste Alary and Me Alexandre Martin, counted on the acceptance of this new request. They put forward the possibility for the suspect to stay with an acquaintance in Ardeche. “Cédric Jubillar is innocent, he has guarantees of representation with accommodation that can be granted to him free of charge” they pleaded last Tuesday. He should also have worn a electronic bracelet.
It is this accommodation that could be made available to Cédric Jubillar that poses a problem. Offered by a friend in Occitania, this development had to be submitted to a performance survey. It was the prison integration and probation service (Spip) that had requested it, due to doubts about the housing sanitation and of potential mobile network problems. Located in a small village in Occitania, the gîte, if it were to serve as a home for Cédric Jubillar, should be placed under video surveillance.
An “empty” file but “serious clues”
Again, the court pointed out that the investigators had “serious and concordant clues”, incriminating the husband of the 33-year-old nurse, mother of her two children. His lawyers, who have pleaded many times for his release, predicted “an announced judicial disaster” since the start of the case. They refer to his file as being “empty” of any overwhelming element.
Last week, experts had discovered traces of “oropharyngeal, digestive and vaginal flora, in small quantities” on a duvet cover.
