Requisitions to ExxonMobil: the administrative court of Rouen rejects the summary of the CGT

Thursday, October 13, 2022, the administrative court of Rouen (Seine-Maritime) examined the summary appeal of the CGT aimed at canceling the requisition of part of the personnel of the ExxonMobil refinery in Port-Jérôme-sur-Seine, which had been stopped since September 20 due to a strike, lifted this Friday, October 14.
Friday, October 14, the administrative court rendered its decision and rejected the summary of the CGT. “The national federation of CGT industries is not justified in maintaining that the requisition measures contained in the decree of the prefect of Seine-Maritime of October 13, 2022 carry a serious and manifestly illegal attack on the fundamental freedom constituted by the right of strike. Consequently, its conclusions relating to the costs related to the proceedings must be rejected”, writes the administrative court of Rouen in its decision.
“A violation of the right to strike” for the CGT
During the hearing, Emmanuel Gayat, the lawyer for the CGT, recalled: “Twelve years ago, the government had, as today, required a whole series of refineries (…) The International Labor Organization had been seized and found that the government’s action constituted a violation of the right to strike”.
For his part, the representative of the prefecture specified that the requisitions did not target the refining activity but the release of fuel stocks. And maintained that the decree proves to be “proportionate” in view of the troubles generated by the blockages.
