The Council restarts, labor reform and Arengo instances in the center of the Chamber
Three days of the Great and General Council of San Marino at Palazzo Pubblico: Monday 26, Tuesday 27 and Wednesday 28 September 2022. In particular, the draft law “Reform of the rules relating to employment”, presented by the secretariat of state for the I work on first reading. Among the innovations we remember that relating to the fixed term, that is the fixed-term employment contract. The new law reduces the maximum duration, passing from 18 months to 12 months maximum with the possibility of 4 extensions in the total 12 months. These limits will not apply for example to seasonal workers (maximum 9 months). It introduces the possibility of hiring all workers part-time, including cross-border commuters, which was not envisaged by the laws in force. Another passage, also often of conflict with the trade unions, is that of article 20, that is, temporary work or administration. In this case, the secretary Lonfernini went straight also (perhaps) the result of a compromise with the social partners. In fact, it is applied (with the rule) to temporary work, the same one that was introduced in 2005 but never applied. In this case, many rules are inserted (a contract between the leasing company and the user, for example, or a guarantee by the leasing company under San Marino law for the wages to be paid to workers), and limits. In fact, it is possible to resort to the administration only for occasional work, seasonal work or for work peaks. (…)
