Brussels scraps the return obligation for trailers • TTM.nl
The European Commission has removed the controversial return obligation for trailers and towed equipment from the Mobility Package.
In June, the explanatory memorandum was published clearly stating that the return obligation also includes gold for semi-trailers and trailers “to the extent that they are available to road transport companies”. The mandatory of drawn material to many at, among others, TLN, that requested clarification from the European Commission. One of the implementation obligations was an implementation obligation in the case of special implementation obligations. With trucks, enforcement via the tachograph is still possible.
The deletion of the sentence about trailers and trailers has yet to happen. The EC this week republished a series of mandatory returns, making it clear that the instructions have been revised. Only motor vehicles and combinations of vehicles used in the country of residence.
TLN also has the EC to get more clarity about the return obligation of the motor vehicle, including the checks on it, the burden of proof and where and how long it really takes. The EC has published the answers in this link.
Vehicle combinations are certainly still subject to the return obligation. There is still a case pending at the European Court of Justice against the return obligation of motor vehicles. It is expected that the Advocate General of the Court of Justice will give his opinion in October and that the Court will give its verdict at the end of December.
