One hundred real estate justice experts meet in Toulouse
From Thursday September 29 to Friday September 30, the National Company of Real Estate Justice Experts is meeting in Toulouse for its autumn university. On this occasion, Jean-Jacques Martel, President of the National Company of Real Estate Justice Experts, which has 250 members, answers questions from La Dépêche Immo.
The National Company of Real Estate Justice Experts has chosen Toulouse for its fall university. From Thursday September 29th to Friday September 30th, gathered at the José Cabanis media library, nearly a hundred experts will look into real estate news. Focus on the Toulouse real estate market, soaring prices of materials, commercial leases, SCI… so many themes to ensure the training of these legal experts.

What is the role of a justice expert?
They are occasional collaborators of justice. We act at the request of magistrates to enlighten them on technical real estate issues. For example, we intervene in rent valuation issues between a merchant and his lessor, division of property when divorced spouses, partners who separate and who must assess the share of the company that is theirs… You should know that the expertise is right. The taxpayer can seize the magistrate when he considers that there is a valuation problem and ask for a third party expert. Because in the end it is up to the judge to decide, neither to the individual nor to the administration, even when it comes to a tax adjustment. And that, people often tend to forget.
How to determine the value of a property?
It is necessary to distinguish the value from the price. Price is an economic concept while value is a legal concept. When you sell a house, the market will speak to regulate the value. On the other hand, in certain situations, the market does not express itself. This is the case, for example, for the valuation of a football stadium, a school complex, etc. At this point, it will therefore be necessary to determine what the market value of the property is. Contrary to the price which has a great part of instinct, the value it results from a method of calculation. It is more objective unlike the price, because it is based on facts and not on market projections. We must be able to justify it.
What is the training of these legal experts?
Unlike the profession of real estate expert which is not regulated, that of legal expert is. It is a status regulated by the Ministry of Justice. There is recognition by the judge. Every year on March 1, the Courts of Appeal keep a list of potential candidates. They are either issued with a master’s type training in expertise in real estate law, business school… or former real estate agents, former architects… Who will put forward their experience as well as a training in law. Without forgetting that justice experts have an obligation to train for 20 hours a year, hence the autumn university on September 29, which is part of this training.
