Switzerland: NCPT reports 33 forced air returns that took place in 2021
Switzerland’s National Commission for the Prevention of Torture (NCPT) recently presented its observations and recommendations in the 33 forced aerial returns.
The 33 forced returns by air were monitored over a nine-month period, from April to December 2021. NCPT also accompanied eight returns on scheduled flights during the period, reports SchengenVisaInfo.com.
NCPT reported on Sir’s forced returns and said it regretted the continued frequent use of partial restraint during transfers and at the airport. She also recommended avoiding violent measures. NCPT said violent measures should only be used in cases where people directly threaten their own safety or the safety of others.
“Although the handling of returnees was generally professional and respectful, the Commission deplores the continued widespread use of partial restraints during transfers and at the airport. In its report, the Commission emphasizes that coercive measures should always be avoided and should only be used in cases where people directly endanger their own safety or that of others.” is the statement of NCPT.
NCPT said that during the above period, it witnessed strict action taken against one or both parents during detention, at the airport and on the plane. Therefore, prison authorities have been recommended to refrain from such restrictions in cases where children are present.
In addition, NCPT also observed that a pregnant woman was handcuffed during a repatriation operation in the presence of her children. The woman had to breastfeed her child in handcuffs and remained so during the doctor’s examination. Such a practice was considered degrading and inhumane given the vulnerability of the pregnant and nursing mother.
“The forced repatriation of this family has been discussed in bilateral talks with the relevant authorities. Various practices which the Commission considers inappropriate were observed again. In this context, the Commission reiterates its recommendations from the reports of previous years.” Added NCPT.
In addition to the above, in 2021 NCPT has also accompanied selective airport transfers of returns of levels two and three.
NCPT said that enforcement level three returns are not clearly distinguished from enforcement level two returns. In addition, independent monitoring must be ensured with regard to coercive measures that are permitted in the context of level 3 returns.
NCPT is also opposed to the use of mandatory COVID-19 testing on people to be returned.
