That’s why the family has to demolish their house in Austria
A judgment from Austria caused a stir last week. A family in the north -Austrian community of Enzenkirchen has to tear down their entire house including pool – despite the building permit.
In 2004, the then mayor granted the family a building permit for the house. This also includes a pool, an attached garage and a garden wall. In the meantime, however, residents from another village have filed a complaint – with fatal consequences for the family.
According to the judgment of the State Administrative Court of Upper Austria, several parts of the house were built on grassland, such as «today» reported. The house is «approx. shifted by 5.5 meters and partly erected on the (grassland)». In addition, the double garage is also about «approx. 5.00 meters moved, »said the court.
“Of course, the family is completely exhausted”
Because some parts of the building were built in the grassland and are not allowed to be built there, a subsequent permit is “out of the question”, according to the court. According to the judges, there was “no valid building consensus”.
Residents from another town had filed a complaint because the community in question had not taken action against illegal construction for a long time. The family’s property was also affected, where certain parts were “postponed and partly built on grassland”.
The mayor of Enzenkirch, Christian Gmundner, said to “Today” that the verdict was “drastic and life-threatening”. “Of course, the family is completely exhausted,” said the mayor. Before the buildings are demolished, however, the family can file a complaint with the constitutional or administrative court. (zis)
