Toulouse: three construction workers at war with their employer

Subcontracting in cascades, black work…. The construction and public works (BTP) sector is not finished with its excesses. And the economic situation is not helping matters. With the shortage of raw materials, many construction sites in the Toulouse conurbation are slowing down, even at a standstill and more and more small businesses are threatened with going out of business. At the end of the chain, it is the employees who toast. Those of the Infynity company, in Saint-Alban, specializing in siding and sealing, already employed in very precarious conditions, have decided to assert their rights. It must be said that the company, registered in the commercial register since the summer of 2021, a year ago, looks like a ghost box. The head office, a vague garage, no longer exists, for lack of having paid the rent, and the three workers, two on fixed-term contracts (CDD) and one without an employment contract, do not hide their concern in an attempt to to recover their salary arrears, approximately €4,000 each.
“The employer broke the contracts at the beginning of the month, without warning them, when they ran until the end of July and we realized that there were, in addition to unpaid bills and concealed work, contribution fraud social”, explains a trade unionist from the National Confederation of Labor (CNT) Industries & Services of Haute-Garonne, who took charge of the case.
The labor inspectorate seized
A picket was organized at short notice in front of the Saint-Alban site for which the company worked. “On site, we found that Infynity was no longer involved as a subcontractor,” said the trade unionist, who alerted the client, a large construction company, to the situation. The CNT was also able to discuss with the boss of Infynity, whom we failed to reach, and the employees concerned sent him formal notices. labor law”, regrets the CNT. Reports to the Urssaf, and to the labor inspectorate have been made and the union is currently preparing a referral to the prud’hommes. “We will continue our actions until the regularization of the situation by the employer, insists on the central trade union. This kind of illegal practice is an attack on all construction workers”.
