Coucoo project, the actors react to the decision of the Toulouse court
After the announcement of the administrative court of Toulouse to suspend the permit to develop, the actors of the project wanted to react.
Friday April 1st was perhaps a key day in the so-called “Coucoo” project of the cabins on Lake Montbel. This project provides for the construction of a residential leisure park in the hamlet of Luga, on Lake Ariège. Referred to in summary proceedings, the administrative court of Toulouse (TA) justified its decision on Friday to suspend the planning permit issued by the municipality last summer, by “the absence of an environmental assessment specific to this project”, according to the ‘ Article L. 122-2 of the Environmental Code.
“We regret this decision”
Gaspard de Moustier and Emmanuel de la Bedoyère, the two founders of the company “Coucoo” expressed their disappointment following this decision. “We regret this decision on two counts. First of all, we have always followed the recommendations of state services, including when filing the application. In addition, we carried out, at the request of the Dreal (Regional Department for the Environment, Development and Housing Editor’s note) and after obtaining the permit, a complete impact study which demonstrates without ambiguity the character virtuous of our project for the environment and biodiversity. The judge chose not to take into account the existence of this impact study for formal reasons (it was not part of the initial file), but we remain confident on the merits. »
For their part, the representatives of the association “à pas de loutre” Lilian Tachon and Laetitia Gergaud said they were “happy to see that justice decides in [leur] favor. It shows that our position is not immature and that we are not “anti everything”.
