Berlin (dpa/bb) – In the dispute over the partially occupied house “Rigaer 94”, the district court of Kreuzberg is examining another eviction action against residents today. The homeowner accuses the tenant of misusing the rooms. The building complex in Berlin-Friedrichshain with around 30 apartments is considered one of the last symbols of the radical left scene and has long been a bone of contention in politics.
More than a dozen eviction actions are pending at the district court in Kreuzberg. The official owner of the building complex is a UK-based company. It is not known who is behind it.
In previous trials, there has never been a decision on the matter itself. For years, the main argument has been whether the plaintiff owner exists under German law and has the legitimacy to seek eviction at all. There should be a legal opinion on this question in another eviction procedure before the district court (Az. 23 C 106/21).
In the years of dispute over the illegal left-wing autonomous bar “Kadterschmiede” in the building complex, the Berlin district court has meanwhile proposed a settlement. Accordingly, the operators should get a rental contract for the use of the rooms that they have been using without a rental contract since the end of 2013, and in future they will pay 650 euros a month in rent. The homeowner should refrain from retrospective rent claims. Both sides wanted to think about the proposal. On March 21, the court will announce how the matter will proceed.
