The Toulouse Métropole local urban plan canceled on appeal
The local urban plan of Toulouse Métropole was canceled by the administrative court of appeal of Bordeaux in a judgment of February 15.
The community is forced to review its copy. The cancellation of the local inter-municipal urban planning and habitat plan (PLUIH) of Toulouse Métropole was canceled by a judgment of the Administrative Court of Appeal of Bordeaux on Tuesday February 15, as reported The Midi Dispatch. This decision follows a first cancellation, by the administrative court of Toulouse on March 30, 2021, which the community contested. A last resort, this time before the Council of State, is still possible for Toulouse Métropole.
The public rapporteur had asked the magistrates to confirm the cancellation by repeating the same arguments of the judges at first instance. In particular, he pointed to the obligation to use natural land less, which is not respected.
But this recourse seems unlikely. Indeed, the community has already voted to draw up a new local urban plan for the 37 municipalities of its territory. It envisages entry into force on January 1, 2025. Pending the drafting of this document which organizes the urbanization of cities, the old PLUs remain in application.
