The Council of State criticizes the “light” measures
The Council of State issued its opinion on the latest Covid bill in Luxembourg, listing several formal oppositions in the matter. While most of them concern “legal insecurities”, in terms of eligibility for the booster dose, an analysis of fundamental revival of the debate on access to places and leisure establishments.
As a reminder, the government has decided to distribute the test, under the CovidCheck 2G + regime (vaccinated or recovered plus test or “booster”), people with a complete vaccination schedule of less than 180 days, those who have received a dose of recall and those who have a certificate of reinstatement. “An approach which seems to be in contradiction with the iterative reduction, from six to three months, of the timeframe from a booster vaccination is accepted, considers”, the Council of State, also generated the much higher contagiousness of the variant Omicron. In this context, the institution “has difficulty in conceiving the logic of the proposed reductions”.
“A blank check”
Another point of divergence is the reduction of the duration of isolation from ten to six days for vaccinated persons. After an infection with Covid-19, the latter can indeed end their isolation provided they have carried out a rapid negative test after six days. If the Council of State does not oppose this logic, the government’s choice to leave people attracted to a rapid test, without certification, is considered permissible.
“The provision as it is written from a blank check to people so that they themselves decide on the end of isolation after six days.” Instead, members of the Council of State proposed that those concerned should use a certified antigen test, “the cost of which could be borne by the community”.
