The defenders’ lawyer said this flatly: He does not want to return to Slovakia for now! Are they afraid of ties?
Miroslav Výboh, a long-time friend of the head of the Direction, Robert Fico, was accused earlier this year in the Mýtnik III police operation of a particularly serious crime of accepting a bribe. He is currently being charged. He was accused on the basis of the statements of two penitents – the director of the Financial Administration, František Imrecze and Michal Suchoba. According to them, Výboh should have demanded a bribe of 150,000 euros for Prime Minister Pellegrini for support in the legislative process of preparation and approval of the law on the virtual cash register. However, the blame denies guilt.
However, the partner of the law firm Dentons and Výbohov, the lawyer Ladislav Smejkal, for Truth claims that the act described is untrue and contrived and did not happen at all. He pointed out that while Imrecze said the deed happened in 2014, Suchoba spoke of 2016 and then miraculously agreed on 2016. However, the legislative process was completed then and the treasury approved in 2014. According to penitents, the bribe took over at the premises of the Monaco consulate at the Carlton Hotel, which, however, does not yet exist in 2014.
“And here the investigator and the supervising prosecutor made another serious procedural error before bringing charges to our client. And so that at first I did not check it very easily in the commercial register and in the lease agreements, or whether the premises where the crime was to take place at all existed. They did so only on the basis of media coverage of the case, when they subsequently proceeded to a physical inspection of the premises, “ Smejkal said, saying that Výboh had approved such steps. Smejkal also described as remarkable that the penitents remembered something new every time they testified. “I don’t know a witness who remembers more and more over time,” warned.
He also criticizes the fact that Pellegrini, whom the lawyer described as a key witness, did not hear the investigator until the very end, shortly before the investigation was completed. “In this case, too, the law enforcement agencies evaluate Imrecze and Suchoba’s statements as credible, but they do not take Petr Pellegrini’s statements into account. In this case, I see the specificity that our client was close to the former Prime Minister Fico. Whether we want to or not, there is a certain political dimension, “ found Smejkal, who subsequently added that Pellegrini himself should have been the end user of the benefits, according to the penitents, and despite the fact that the bribe was to be directed at him, he is only in the position of a witness.
According to Smejkal, however, the whole thing would have been time-barred if it had happened in 2014, as Imrecze had originally claimed. He added that the information that they had not reacted to the police ‘s proposals for a telegram interrogation for more than two months was also untrue. Suchob himself was heard in this way in the United Arab Emirates. According to the Defender’s Advocate, they responded after about a month. But why did it take so long to write an answer?
“It takes some time to set it up, and NAKA itself warned us that the whole thing would technically take at least three to five weeks. Another complication was the request from NAKA to specify who will defend who will be in Slovakia and who in Dubai. In addition, the calendars had to be harmonized. The fact that we decided after four days, when we had already proposed specific dates in December and January with the presence of lawyers, was because it took us a while to reconcile the whole thing., “ Smejkal explained, adding that the Office of the Special Prosecutor’s Office filed a charge in three months, even at the cost of violating the law, and they are acting in violation of the law.
“It started because clients did not file a resolution to charge. It has not been delivered to him to date. Subsequently, they made him a refugee, so they have not delivered anything to him since. We have proposed evidence, witnesses, a confrontation, and today we do not know how the police dealt with it. “ Smejkal pointed out, who added that the investigator had also terminated the investigation without a valid resolution on the charges, which he had not encountered in his twenty years of practice. According to him, those active in criminal proceedings know that Výboh does not live in Slovakia for a long time and has a permanent residence in Monaco, nevertheless they send him shipments to an address in Zvolen, where they have not lived for many years. “One can then feel that it is laziness at best and doing it intentionally at worst. An even greater absurdity is that the prosecutor in another criminal case sends him documents to an address in Monaco. ” said the lawyer.
In addition, Výboh has a 5-year temporary residence in Dubai, where it is currently located. Smejkal ruled out that he would be there on the run and there are no plans to return in Slovakia yet. In addition, Smejkal assumes that Peter Pellegrini will also testify as a witness at the hearing on the Specialized Criminal Court. It is not yet clear whether Výboh will also appear at the hearings. “I admit I haven’t asked him about this yet. We will now focus more on highlighting a number of procedural errors and expecting the charge to be dismissed. If I refuse, we will also start to address the strategy for the main hearings. For us, this question is still premature. He still believes that in Slovakia he will be purged and acquitted in full, “ Smejkal concluded.
