“Supported to make general interests prevail over those of the shop”
We have repeatedly said that, in this moment of great difficulty for San Marino, the government and the opposition wished, while respecting their roles, an instrument of permanent consultation and sharing of fundamental choices. Certainly the Constitutional Reform on Justice approved during this council session represents a missed opportunity, although the topic certainly cannot be considered of secondary importance and indeed represents the necessary precondition, even if not sufficient, for the country to restart. This is a good reform at least from the point of view of the principles it enunciates, in full compliance with the Directives of International Bodies. By way of example, it is enough to recall the achievement of the formal Independence and Autonomy of the Judiciary through the failure of the self-governing body of active politics, the introduction of intermediate sanctions and the provision of a regulation for the application of sanctions to the Magistrates. Yet there are many elements of novelty introduced, such as the possibility for lawyers to sit within the Plenary Judicial Council, or the choice by the Government to legislate with constitutional legislation also on topics that for the Charter of Rights should be treated through Qualified Law, which would be General monitored in its application for the Great Council and return soon to adjust any that emerge in its application. Nonetheless, in the Chamber, the usual logic of opposing ovens has been witnessed, which has caused wounds that have never subsided and the return to initiatives devoid of any foundation but which do a lot of harm to the country such as the imaginative use of International Organisms regardless of the damage to image that is creates to the Republic. For these reasons, the Socialist Ideals Movement – albeit firmly in opposition to this Government and this frayed, incoherent and not very conclusive Majority – intended to support the reform of the Judiciary by trying to make general interests prevail over those of the shop. With all due respect to the screamers and the scandalized of the last hour who seemed only interested in the management of the judicial power pro domo proprio, as they have been accustomed to for too long.
