Vaccination is possible, but details are unclear
Coronavirus
A vaccination requirement is constitutionally possible, but details are still unclear. About what age it could apply, says the Salzburg constitutional lawyer Benjamin Kneihs. The federal government has announced that everyone will be vaccinated at the beginning of February.
If the federal government has its way, the general compulsory vaccination should come into force on February 1, 2022. Until then, however, there are still a few questions to be clarified. About what age this should apply. Compulsory vaccinations would be problematic for minors, says Benjamin Kneihs, constitutional lawyer at the University of Salzburg.
Compulsory vaccination would probably stay longer
In addition, the legal scholar expects permanent vaccination. Such an obligation would have to be lifted, namely only with the specific quote: “I point out that the vaccination quota must be maintained. We will probably have to get used to the fact that the vaccinations are constantly being refreshed. In this respect, it is such a thing with the lifting of the compulsory vaccination. If the vaccination quota is maintained at the required level over the long term, it WILL have to be lifted, ”said Kneihs.
Fines or hospital deductibles are conceivable
The legal scholar also believes that fines or deductibles are possible for those who refuse to be vaccinated during hospital stays. A draft law on mandatory vaccination for health professionals provides for fines of up to 3,600 euros. It is unclear whether the same could apply to the general compulsory vaccination.
