The respondent, who is a 30-year-old Algerian national in a legal situation in France, was arrested after trying to flee on foot. Well known to the police and the judiciary, he had already been arrested in Marseille last week for the concealment of theft and rebellion. After refusing a check while driving a stolen car, he lost a vehicle and ran away, describes a second police source. The fugitive then tried to steal a scooter by threatening the driver with a knife, as well as the three police officers who came to question him. Under the influence of cocaine, he had rebelled when he was overpowered by the agents.
At the end of his police custody, he was finally left free under judicial control while he was the subject of an arrest warrant for a three-year prison sentence to be served according to the same source. “He suffers from a health problem and the judge of freedoms and detention decided that he would not go to prison, contrary to the requisitions of the prosecution”, explains Rudy Manna, regional secretary of the Alliance Police Nationale union. “It’s just unbearable!
