The respondent, who is a 30-year-old Algerian national in a legal situation in France, was arrested after trying to flee on foot. Well known to the police and the judiciary, he had already been arrested in Marseille last week for the concealment of theft and rebellion. The fugitive then tried to steal a scooter by threatening the driver with a knife, as well as the three police officers who came to question him.
