Council of States announces revised Posting Act
The cantons should take care of their own minimum wages for workers posted from abroad. With this argument, the Council of States did not advocate a revision of the Posting Act on Wednesday. Social policy is a matter for the canton, it said in the council.
Commission spokesman Hannes Germann (SVP / SH) said the minimum wage laws would be very different in Neuchâtel, Geneva, Jura and Ticino, where the minimum wage is already in force.
In the Jura, for example, the minimum wage applies to everyone who works in the canton.
In Neuchâtel, Geneva and Ticino, the minimum salary applies to those who usually work in the canton. A regulation at the federal level is not necessary.
Paul Rechsteiner (SP / SG) resisted. In the consultation, 23 cantons would have spoken out in favor of a national regulation for the implementation of cantonal minimum wages for posted workers. This is particularly important for Ticino with the strong wage pressure from Lombardy.
If a canton issued minimum wages, this would also apply to posted workers. In addition, the Council of States itself supported the motion that initiated the revision of the law. Council colleague Christian Levrat (SP / FR) seconded him with the principle: “same place, same work, same wage”.
Ruedi Noser (FDP / ZH) objected that the four cantons with a different minimum wage excluded the beneficiaries from the regulation. If Ticino suffers so much from the problem, it has every means to find a solution.
Benedikt Würth (center / SG) reminded that the cantonal minimum wages are not in a legally free area. In accordance with the accompanying measures for the free movement of persons, they must in any case be customary for the location and branch.
Federal President and Minister of Economic Affairs Guy Parmelin broke a lance in vain for the revision. The Federal Council had carried out the parliamentary mandate that. In addition, the revision regulates the enforcement powers of the federal government. And an electronic platform is also part of the template.
The Council of States did not approve the revision with 25 to 17 votes. The proposal goes to the National Council. In addition to the four cantons with already registered minimum wages, the voters of the canton of Basel-Stadt approved a minimum wage in June.
