Failure to recognize arrears, appeal by seven officials to Strasbourg
There is a case in which seven agents of the Guardia di Rocca, enlisted between 2006 and 2008, are appealed before the Court of Strasbourg. After the internal judicial process, the case reached the ECtHR and was made public two days ago on the Court’s website. The seven appeals concern a regulatory intervention concerning the retroactive adjustment of the appellants’ careers. “According to the appellants – reconstructs the ECtHR – pursuant to law no. 99 of 1997, their definitive hiring had to be confirmed following a one-year probationary period, which also provided for the related career advancement. However, their hiring only became definitive with the resolution of the Council of 18 January 2016, in the light of article 63 of law no. 189 of 2015”, attributing them a fifth level. “Immediately afterwards – continues the reconstruction of the ECHR – on dates between 28 January and 2 February 2016, the applicants asked the State Human Resources Department to calculate the retrospective adjustment of their careers pursuant to law no. 189 of 2015” (…)
